Michael O’Neill
Managing Partner

Michael
began practising in 1981 and was a founding partner of NOT
Lawyers. He has specialised in corporate commercial litigation,
with an emphasis on insolvency and company litigation. Michael
has handled matters in all jurisdictions including the High
Court, the Federal Court and the Supreme Court in relation
to most commercial matters including trade practices law, company
applications, contract disputes, and recovery matters for lenders.
For example, Michael has acted in disputes involving claims
in excess of $400 million which have required him to
spend the majority of his working week over a two-year
period on the one piece of litigation. Michael also acts
for the Special
Purpose Liquidator of
One.Tel Limited (in Liquidation) in relation to the
investigation of potential claims in excess of $100
million.
As a corporate insolvency
lawyer, Michael has advised banks, boards of directors,
insolvency practitioners, individual directors and employees
and creditor suppliers in relation to all aspects of insolvency
law ranging from preference recoveries to complex misfeasance
proceedings.

Simon Gallant

Simon
began practising in 1985 and joined NOT Lawyers as a
partner in October 2000.
Simon has wide experience of corporate and insolvency
law in both the UK and New South Wales. Simon primarily
practises in corporate insolvency and reconstruction
and acts for a number of liquidators and administrators.
In addition, he provides advice to directors in a range
of matters that arise in day to day business.

David Evans

David
commenced practising in 1994, joined NOT Lawyers in
2001, and was appointed as a partner in January 2004.
David’s
early practice revolved around a combination of transaction
and litigation work, primarily in the context of insolvency,
real property and securities. In his time at NOT Lawyers,
he has successfully developed a commercial and domestic
conveyancing, leasing and mortgage practice and he is
much sought after in this area. David continues to oversee
many multi-million dollar transactions, as well as complicated
commercial and property litigation matters. He has established
a loyal client base over his thirteen years in practice.

Jacki Cole
Senior Associate |
Jacki is a commercial litigation/insolvency practitioner who graduated in law and commerce (accountancy) in 1994 from the University of Otago in New Zealand. After a number of years in practice in NZ, Jacki became a solicitor of the Supreme Court of New South Wales in January 2002 and is also on the Register of Practitioners of the High Court of Australia.
Jacki has conducted complex commercial litigation in the Supreme and District Courts of NSW (including matters which have gone on appeal to the Court of Appeal) and is also familiar with the practice and procedure of the Local Court of NSW and various judicial/quasi judicial tribunals. She has conducted numerous bankruptcy matters in the Federal Magistrates Court of Australia, acting on behalf of petitioning creditors as well as on behalf of debtors.
Jacki has acted, and continues to act, for liquidators and administrators and also for company directors and individual litigants in a variety of jurisdictions and in relation to diverse areas of law including insolvent trading, breach of contract, oppression of minority shareholders and preference recovery actions.
Jacki is a member of the Law Society of New South Wales and is also a member of the Insolvency Practitioner’s Association (IPA).

Ted Popper

Ted has been practising since 1985. He has been a senior litigation solicitor with NOT Lawyers since 2000.
Prior to joining NOT Lawyers, he was a senior litigation lawyer with Solomon Garland Partners, a barrister at
Blackstone Chambers and Nigel Bowen Chambers and a commissioned Legal Officer with the Royal Australian Navy.
Ted’s practice areas are Commercial Litigation, Insolvency Litigation and Alternative Dispute Resolution.
Ted has conducted complex commercial litigation in the Federal Court of Australia, Supreme Court of NSW and
District Court of NSW. He has acted for liquidators, receivers and administrators and also for directors,
creditors and debtors.
He also has extensive experience as an advocate at the Sydney Bar, as a solicitor and as a legal officer in
the Navy and later member of the NSW Legal Panel of the RAN Reserve appearing in courts-martial as both
prosecutor and defence counsel.

Alan has, for most of his career, worked with top tier law firms. He has particular experience in insolvency

litigation matters involving telecommunications, insurance, intellectual property, taxation and debt recovery, as
well as giving day to day corporate advice. Alan conducts litigation matters for clients in all

2001.
Bill’s practice areas include commercial litigation,
insolvency litigation, employment litigation as well
as commercial transaction work including the sale and
purchase of businesses.
Since joining NOT Lawyers Bill has been involved in complex
commercial litigation in the Supreme Court of New South
Wales and the District Court of New South Wales on behalf
of company liquidators, directors and individual litigants.
At the same time Bill has handled a number of complex commercial transactions including corporate mergers and
the sale and purchase of businesses.

Colin Brown

Having returned to Australia after a working sojourn in London, Colin joined the firm in April 2005. Since then he has brought to bear a commercial outlook to dispute resolution, along with a focus on providing the best result for his clients, whether via litigation or alternative dispute resolution avenues, in a wide range of matters.
A member of the Insolvency Practitioners Association of Australia, Colin has a strong background in the insolvency arena, and regularly advises and acts for insolvency practitioners on a wide range of matters, including issues arising from voluntary administrations, liquidations and receiverships, as well as acting for directors or creditors in respect of insolvency related matters.
Colin also acts for private and corporate clients involved in commercial litigation, particularly in respect of contract and commercial transaction disputes.
As well, he is the author of the firm’s bi-monthly Insolvency and Litigation Practice Alerts, providing comment and insight into developments and issues of importance in the area.
Colin also finds time for his weakness for team sports, particularly cricket and all forms of football.

Lynda Lim

Lynda completed a combined Bachelor of Laws/Bachelor of Arts degree at the Australian National University in 2000 and was admitted as a Solicitor of the Supreme Court of New South Wales in 2001. Lynda commenced with NOT Lawyers in 2005
Lynda’s main areas of practice include commercial litigation, dispute resolution and corporate insolvency with a particular emphasis on mortgage recovery, re-possession of land claims, equipment finance, property & contractual disputes, commercial debt recovery and actions under the Trade Practices Act and Corporations Act.
Lynda has acted on behalf of Plaintiffs and Defendants in a wide range of litigation matters at various jurisdictions. Emma has completed a combined Bachelor of Business (Economics) and Bachelor of Laws at the University of Technology Sydney in 2007 and has recently been admitted as Solicitor in the Supreme Court of New South Wales in 2008.
Emma joined NOT Lawyers in May 2008, after working as a paralegal in property and construction litigation and later as a policy adviser in both an economic and legal perspective for State Government, in consumer law.
